The Galeana Group — SMS / MMS Terms & Conditions

Welcome to the text messaging program (“Program”) operated by The Galeana (“Company,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your participation in our SMS and MMS communications and supplement our Privacy Policy and Website Terms of Use.
By opting in to receive text messages from us, you agree to be bound by these Terms. If you do not agree, please do not enroll in the Program.
1. Program Overview
Our text messaging Program allows subscribers to receive mobile messages regarding account activity, customer support, notifications, alerts, offers, updates, reminders, and other related communications. Depending on your subscription type, you may receive both transactional and promotional messages.
2. Consent to Receive Messages
By providing your mobile number and opting in, you expressly consent to receive recurring automated text messages (SMS and/or MMS) from or on behalf of The Galeana Group at the mobile number you provided. These messages may be sent using an automatic telephone dialing system (“ATDS”) or other automated systems.
Consent is not required as a condition of purchasing any goods or services. You represent that you are the owner or authorized user of the mobile number you provide and that you are at least 18 years of age (or have consent from a parent or guardian if under 18).
3. Message Types and Frequency
Message frequency will vary based on your interactions with us, your account status, and program selections. Typical frequency: up to 3 messages per week.
Examples of message types include:
Transactional updates (purchase confirmations, shipping alerts, appointment reminders)
Account notifications (password resets, billing updates, service changes)
Customer support and feedback requests
Marketing and promotional offers (only for those who opt in to marketing messages)
4. Opting In
You may opt in by checking the SMS consent box during sign-up, submitting your phone number via our web forms, texting a keyword to our designated number, or otherwise providing express written consent.
Sample consent language:
“By providing your mobile number and clicking ‘Submit,’ you agree to receive recurring automated promotional and personalized marketing text messages from The Galeana Group at the mobile number provided. Consent is not a condition of purchase. Message frequency varies. Msg & data rates may apply. Reply STOP to cancel, HELP for help.”
5. Opting Out
You can cancel the Program at any time by replying STOP to any of our text messages. After you send STOP, we will send one final message to confirm that you have been unsubscribed. You will no longer receive text messages from us unless you opt in again.
Alternate keywords such as END, CANCEL, UNSUBSCRIBE, or QUIT are also recognized.
6. Help and Support
For help at any time, reply HELP to a message or contact our customer service team at Management@galeana-groiup.com or (832) 889-0500. We may provide instructions or direct you to other resources for assistance.
7. Message and Data Rates
Message and data rates may apply depending on your wireless carrier plan. You are responsible for any costs associated with receiving or sending messages under your mobile subscription plan.
8. Supported Carriers
Our messages are supported by most major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and others. However, we are not responsible for delayed or undelivered messages caused by carrier or network issues.
9. Privacy and Data Usage
Your privacy is important to us. We collect and use personal information in accordance with our Privacy Policy. This includes information you provide directly (such as your phone number) and data related to your message interactions (delivery confirmations, opt-in/opt-out history).
We do not sell, rent, or share mobile numbers with unaffiliated third parties for their own marketing purposes.
10. Program Availability and Suspension
We reserve the right to modify, suspend, or terminate the Program or your participation at any time, without prior notice, for any reason, including but not limited to technical issues, carrier restrictions, misuse, or suspected unauthorized use.
11. Indemnification
You agree to indemnify, defend, and hold harmless The Galeana Group, its officers, directors, employees, affiliates, and service providers from and against any claims, damages, liabilities, losses, or expenses arising from your participation in the Program or any violation of these Terms.
12. Disclaimer of Warranties
The Program and all messages are provided on an “as is” and “as available” basis. We make no warranties or representations of any kind, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement.
13. Limitation of Liability
To the maximum extent permitted by law, The Galeana Group and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in the Program. In no event shall our total liability exceed one hundred U.S. dollars ($100.00).
14. Governing Law and Dispute Resolution
These Terms and your participation in the Program are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Sheridan, Wy.
15. Changes to These Terms
We may update or amend these Terms at any time by posting an updated version on this page with a revised effective date. Continued participation in the Program after such changes constitutes your acceptance of the updated Terms.
